 Supreme Court on 15 April, 2025 said- If any newborn infant is trafficked from any hospital, the immediate action against the hospital should be suspension of licence to run the hospital over and above other actions in accordance with law.

SUPREME COURT-UPHELD

 The Supreme Court on 15th April 2025 has upheld the constitutional validity of section 498A IPC, rejecting a challenge that claimed the provision violates Article14. The Court emphasized that Article 15 of the Constitution explicitly allows the State to enact special laws for the protection of women. It clarified that allegations of misuse of Section 498A must be assessed On a case-by-case basis, rather than by striking down the law itself. Justice Surya Kant  Justice N. Kotiswar Singh
